Terms of Service

1. Introduction

Welcome to CarryFriend ("Platform", "we", "us", or "our"), operated by CarryFriend Pvt. Ltd., a company incorporated under the laws of India. By accessing or using our platform available at carryfriend.in and its mobile applications (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms").

Please read these Terms carefully. If you do not agree to these Terms, you may not use our Service.

2. Platform Description

CarryFriend is a social companionship marketplace that connects users ("Users") with verified individuals ("Buddies") for lawful, above-board social activities including but not limited to:

  • Travel and sightseeing
  • Shopping assistance
  • Event attendance
  • Gaming sessions
  • Conversation and emotional support
  • General companionship

CarryFriend is strictly NOT an escort service, dating service, or adult entertainment platform. Any use of the platform for illegal, sexual, or inappropriate purposes will result in immediate account termination and may result in legal action.

3. Eligibility

To use CarryFriend, you must:

  • Be at least 18 years of age
  • Be a resident of India
  • Have a valid Indian mobile number
  • Agree to these Terms and our Privacy Policy
  • Not be barred from using the Service under applicable laws

4. Account Registration

You must create an account to use our Service. You agree to:

  • Provide accurate and complete information during registration
  • Keep your account information updated
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access to your account
  • Be responsible for all activities that occur under your account

5. Buddy Verification & KYC

Buddies are required to complete Know Your Customer (KYC) verification before being listed on the platform. This includes:

  • Government-issued photo ID (Aadhaar card mandatory)
  • Live selfie verification matching the submitted ID
  • Background verification for Regular and Elite tier Buddies

Providing false KYC documents is a criminal offense. CarryFriend will cooperate fully with law enforcement in such cases.

6. Booking & Payment

All bookings are subject to the following:

  • Payments are processed through Razorpay and held in escrow until session completion
  • Platform fee of 20% applies to all bookings
  • GST of 18% applies on the platform fee
  • Cancellation more than 2 hours before session: full refund
  • Cancellation less than 2 hours before session: 50% refund
  • No-show without cancellation: no refund
  • Buddy-initiated cancellation: full refund to User

7. Prohibited Activities

The following activities are strictly prohibited on CarryFriend:

  • Requesting or providing sexual services of any kind
  • Harassment, abuse, or threatening behavior
  • Physical violence or threats thereof
  • Sharing or soliciting personal contact information to bypass the platform
  • Impersonation of any person or entity
  • Using the platform for illegal activities
  • Off-platform payments to Buddies
  • Creating fake reviews or ratings

8. Dispute Resolution

In case of disputes between Users and Buddies, CarryFriend will act as mediator. Our decision on disputes related to refunds and account actions will be final and binding. For legal disputes, the jurisdiction shall be courts in Delhi, India.

9. Intermediary Status & Limitation of Liability

CarryFriend Pvt. Ltd. is an "intermediary" as defined under Section 2(1)(w) of the Information Technology Act, 2000. As an intermediary, CarryFriend claims the safe harbor protection under Section 79 of the IT Act, 2000 and is not liable for any third-party information, data, or content made available by Users or Buddies on the platform, provided that CarryFriend:

  • Does not initiate the transmission of content
  • Does not select the receiver of the content
  • Does not select or modify the content
  • Observes due diligence as prescribed under the IT Rules, 2021

CarryFriend is not responsible or liable for any illegal, sexual, abusive, or criminal activities conducted by Users or Buddies during or outside sessions. Individual users are solely responsible for their own conduct and actions. CarryFriend will cooperate fully with law enforcement agencies in case of any reported illegal activity.

Our total financial liability to you shall not exceed the amount paid by you in the last 30 days.

9A. IT Rules 2021 Compliance

In compliance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021:

  • Grievances acknowledged within 24 hours, resolved within 15 days
  • Users must not host, display, upload, modify, publish, transmit, or share any obscene, pornographic, or illegal content
  • Platform will remove/disable access to prohibited content within 24 hours of receiving a court order or government directive

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the new Terms.
